尼伯特颱風來襲，媒體報導桃園某電子公司發出公告，「若7月8日沒來上班的同仁，統一調班7月10日為正常班」。勞動部今天(8日)表示，工作時間及工作日為勞動契約的重要內容，雇主不得未經勞工同意片面公告變更調整，由於此案未事先徵得勞工同意，勞動部表示，此公告不具效力。
勞動部強調，勞工如於原約定正常工作時間外出勤，應屬延長工時，雇主應給付勞工加班費。
勞動部說明，工作開始及終止之時間、休息時間、休假、例假等屬勞動契約之重要內容，應由勞雇雙方在不違反勞動基準法規定之前提下，於勞動契約中約定，並依約履行。雇主如欲調整上開事項，必須與勞工重行協商並徵得勞工同意。
勞動部指出，依勞動部訂定之「天然災害發生事業單位勞工出勤管理及工資給付要點」，勞工因天然災害致未出勤，非可歸責於勞工，雇主不得視為曠工、遲到或強迫勞工以事假或其他假別處理，且不得強迫勞工補行工作。
